ASSISTANCE BY CLIENT TO ENSURE MINIMUM OF
DELAYS IN TRANSFERS:
Your Documents: Your ID documents, ANC, marriage certificate and, if applicable, your divorce order will be required to prove your marital status.
Costs: See our table of transfer costs and bond costs to ensure that you have this available at the time of signing your documents with the attorney.
Signing of documents: Arrange to sign the documents as soon as you are requested to do so by the attorney.
Contract: Study this carefully and ask the attorney to assist you to ensure that all the provisions are clear and are being attended to. This may include the electrical clearance certificate, the date of occupation and the date on which guarantees must be delivered.
PROCEDURE TO BE FOLLOWED TO REGISTER TRANSFERS
On receipt of instructions: Upon receiving instructions from the agent to attend to registration of transfer, we peruse the agreement of sale to establish whether there are suspensive conditions and/or restrictive conditions, do a deed search on the property, acknowledge receipt of instructions; and request cancellation figures from the existing bondholder to enable us to request guarantees and to prepare our transfer documents; apply to the local authority or body corporate (in event of sectional title) for outstanding figures on rates and taxes and valuation certificate or levies payable to obtain a clearance certificate or a levy clearance.
Contact with clients: We now correspond with the Seller and Purchaser, advising them that we have received the instructions, that we are awaiting cancellation figures and the Deed of Transfer from the existing bondholder; request them to furnish us with the following documents, should we not have received same from the agent.
